General Terms of Use Ticket Shop
Genneral Terms and Conditions for the Online Purchase of Tickets for EMO Hannover 2023
The following General Terms and Conditions (hereinafter referred to as "GTC") apply to the brokerage of e-Tickets and registration codes (hereinafter referred to only as "Tickets") in the Online Shop of Deutsche Messe AG, Messegelände, D-30521 Hannover (hereinafter referred to as "Deutsche Messe") on the Website of EMO Hannover 2023 https://visitors.emo-hannover.de/ (hereinafter referred to as the "Website").
Deutsche Messe makes its Online Ticket Shop available to the Verein Deutscher Werkzeug-maschinenfabriken e.V. (hereinafter referred to as "VDW"), Lyoner Strasse 18, D-60528 Frankfurt am Main, Germany, as the organizer of EMO Hannover 2023 (hereinafter referred to as the "Event") for the sale of Tickets. Deutsche Messe shall sell the Tickets merely as an agent on behalf and for the account of VDW. With regard to the Event itself, a contract shall be concluded between the lawful purchaser of the Tickets and VDW.
VDW reserves the right to make changes to the GTC in case of objective justification, such changes to become effective as soon as they have been published on this Website. VDW also reserves the right, at its sole discretion and without prior notice, to discontinue or modify the Website in whole or in part.
By placing an order, the purchaser of Tickets (hereinafter referred to as the "Customer") accepts these GTC. Deviating conditions of the Customer shall not be valid.
The Customer agrees to use this Website exclusively to purchase Tickets. Without express permission, it is prohibited to establish deep links to this Website - for any purpose whatsoever.
The Customer undertakes not to use any robot or spider software, nor to attempt in any other way - either automated or manual - to monitor or copy this Website and its content. He also undertakes not to disrupt the proper functioning of this Website in any way whatso-ever, and in particular by deliberately overloading Deutsche Messe's system infrastructure.
VDW will investigate any illegal and/or unauthorized use of this Website, including but not limited to unauthorized Ticket purchases, unauthorized framing of or linking to the Website, or unauthorized use of any robot, spider, or other software, and will take appropriate civil and criminal action.
VDW is the issuer of the Tickets. The purchase of Tickets creates a contractual relationship exclusively between the respective Customer and VDW.
A Customer account is required to purchase Tickets on https://visitors.emo-hannover.de/. For this, the Customer must register once. Information on the handling of data collected dur-ing registration is available at https://visitors.emo-hannover.de/en/emo-hannover/privacy-policy .
After creating a user account, the Customer can log in to the ticket shop and purchase a Ticket (e-Ticket) personalized in his name. He can also order Tickets in the form of registra-tion codes for third parties.
By clicking the corresponding order button, the Customer sends his order and submits a binding offer for the conclusion of the Contract. During the order process, the Customer must enter specific information on the order quantity (number of Tickets), his correct e-mail address as the delivery address and all data necessary to process the payment.
Once the order has been sent and received, the Customer will receive an e-mail confirming the purchase. With the sending of this confirmation notice (hereinafter referred to as the "Purchase Confirmation"), the contract of sale for Tickets between the Customer and VDW comes into effect (hereinafter referred to as the "Contract").
The Purchase Confirmation includes the invoice in PDF format. The Tickets are available directly after purchase and at any time via the Customer's login area.
Right of withdrawal
If the Customer is a consumer within the meaning of § 13 BGB, he may revoke his declara-tion of intent to conclude the Contract within 14 days without stating reasons by using the withdrawal form (a sample withdrawal form can be found below) or by making an express declaration (e.g. letter, e-mail, fax) to VDW. To meet the deadline, it is sufficient to send the withdrawal form or to submit the withdrawal declaration to VDW in good time. The withdrawal period begins with the conclusion of the Contract, but not before the consumer has been informed by VDW in accordance with the statutory requirements (Section 312 j (2) BGB in conjunction with Article 246a § 1 (1) sentence 1 no. 1, 4, 5, 11 and 12 of the Introductory Law of the Civil Code (EGBGB)).
Withdrawal is only possible within the withdrawal period until the time at which the Ticket loses its validity, i.e. at the end of opening hours on the respective day (day Tickets) or last day of the trade fair.
The withdrawal declaration must be sent to:
Verein Deutscher Werkzeugmaschinenfabriken e.V. (VDW)
Lyoner Strasse 18
D-60528 Frankfurt am Main, Germany
Tel. +49 69 756081-0
vdw@vdw.de
Consequences of a withdrawal
If the right of withdrawal is effectively exercised, the Tickets in question will be blocked so that access to the respective event will not be possible. In the event of an effective withdrawal, VDW will refund the Ticket price already paid by the consumer without delay, but no later than after 14 days.
The period shall commence for the consumer upon sending the withdrawal form or otherwise submitting the declaration of withdrawal, and for VDW upon receipt. VDW is free to choose the means of repayment for the Ticket price already paid. No fee shall be charged to the consumer.
By way of principle, purchased Tickets (incl. registration codes) may not be returned. Each order of Tickets is therefore binding immediately upon receipt of the confirmation email and obliges the Customer to accept and pay for the transmitted Tickets. There will be no refund of the purchase price for unregistered or unused registration codes.
An exception applies only to Tickets for (a) canceled or (b) rescheduled events. In such cases, the original Customer may claim from VDW the reimbursement of the Ticket price actually paid. Tickets do not have to be returned, but are automatically declared invalid. Furthermore, no claims for reimbursement of wasted expenditure will be entertained.
In case of loss of Tickets, a refund of the purchase price is not possible.
Ticket prices are always subject to change and include the statutory value added tax. The prices stated on the respective Website at the time of the order will apply.
The total price including VAT is due immediately after conclusion of the Contract. Payment can be made by credit card (VISA card, Euro Mastercard) or PayPal.
The Tickets are valid only after full payment has been made. If a payment is charged back, the Tickets / registration codes will be automatically invalidated.
The invoice is issued in the name and on behalf of the
Verein Deutscher Wekrzeugmaschinenfabriken e.V.
Lyoner Strasse 18
D-60528 Frankfurt am Main, Germany
service-hotline@messe.de. The respective invoice is sent to the Customer as a PDF file together with the confirmation message. The Tickets do not constitute a receipt
By ordering Tickets, the Customer declares his consent to the creation and sending of in-voices electronically in unencrypted form. There is no entitlement to invoicing by invoice document.
For questions regarding payment and/or invoices, please contact Deutsche Messe AG directly (service-hotline@messe.de).
Tickets and registration codes are transmitted by making them available for download in the Customer's user account. The Customer is obliged to check the tickets for correctness and completeness immediately upon receipt, i.e. in particular the name of the Event, date, time, price and quantity, and to notify Deutsche Messe of any complaints within 3 working days by e-mail to service-hotline@messe.de.
The Customer may not reproduce, duplicate, or modify the printed Ticket. The purchase of Tickets for the purpose of resale is prohibited.
An unauthorized duplicated or resold print@home ticket does not entitle the holder to at-tend the Event. The single-use barcode on the Ticket is electronically validated by barcode scanners at the venue. Consequently, there is no way that, e.g. by duplicating the barcode, other persons with the same barcode can gain access to the event.
In the event that copies of this print@home Ticket are discovered, VDW reserves the right to deny access to the Event to the holders of the copies or to the holder of the unauthorized print@home Ticket. Furthermore, it reserves the right to demand payment of the total value of the duplicated print@home Tickets from the Customer whose ticket was duplicated without authorization due to his fault.
The print@home Tickets should be stored in a safe place, just like cash or conventional tick-ets, to prevent misuse. VDW bears no responsibility whatsoever in the event of loss and/or misuse of the Ticket.
VDW shall be liable without limitation for damage suffered by the Customer only to the ex-tent that such damage is attributable to its intentional or grossly negligent conduct.
In the case of slightly negligent breaches of duty, VDW shall only be liable for the breach of one of its essential contractual obligations (cardinal obligation). In that case, VDW's liability is limited to the direct damage typical for the Contract and foreseeable at the time of conclusion of the Contract. This also applies to breaches of duty by legal representatives and/or vicarious agents of Deutsche Messe.
Liability for culpable injury to life, limb or health shall remain unaffected by this limitation of liability.
VDW does not guarantee that the operation of the Website will be uninterrupted or error-free. It will endeavor, as far as technically possible, to keep the operation of the Website free from errors and interruptions.
VDW also provides no guarantee that the Website is free of viruses or other sources of disruption. Liability is therefore also excluded in this regard.
The law of the Federal Republic of Germany shall apply exclusively to the exclusion of the UN Convention on Contracts for the International Sale of Goods and the German text version.
The EU Commission provides a platform for out-of-court online dispute resolution (ODR platform), which can be accessed at https://ec.europa.eu/consumers/odr .
VDW is neither legally obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board pursuant to the German Consumer Dispute Resolution Act (VSBG).
The place of jurisdiction for all legal disputes arising from the Contract shall be Hannover if the contracting parties are merchants, legal entities under public law or special funds under public law or if at least one of the contracting parties does not have a general place of jurisdiction in the Federal Republic of Germany, or relocates its domicile or habitual residence outside the Federal Republic of Germany after conclusion of the Contract or its domicile or personal residence is not known at the time the action is filed. VDW is also entitled to bring an action at the Customer's general place of jurisdiction. The place of performance for all obligations arising from this Contract is Hannover.
Should one or more provisions of these GTC be or become invalid, this shall not affect the validity of the remaining GTC and the validity of the Contract.
